Operational, safety, confidentiality, cash handling, vehicle, app-use, and labor-law terms for delivery work.
This Delivery Partner Agreement is used between MarketLiberiAll, Inc. and a person or entity performing delivery work. The signed schedule identifies the delivery partner, engagement start date, county or zone, vehicle type, equipment, compensation method, status of engagement, and any special terms.
If the signed schedule states that the delivery partner is an employee, employment terms must comply with the Decent Work Act of 2015, applicable wage rules, statutory deductions, NASSCORP obligations, leave rights, overtime rules, and workplace rights. If the signed schedule states that the delivery partner is an independent contractor, the contractor terms and the signed schedule control subject to law. Nothing in this template reduces rights that cannot lawfully be waived.
Delivery partners pick up, transport, safeguard, and deliver assigned orders; follow lawful route, safety, custody, proof, and cash procedures; use the MarketLiberiAll delivery app as instructed; and communicate promptly about failed pickup, failed delivery, damage, loss, customer unavailability, unsafe locations, accident, or incident.
A delivery partner who collects cash on delivery holds that cash for MarketLiberiAll and must remit it through the instructed process by the required deadline. Delivery completion and cash remittance are separate obligations.
Cash collection must match the order amount and currency. A delivery partner must not discount, increase, borrow, mix, delay, or use collected cash. Shortage, late remittance, false remittance, or misappropriation may lead to workspace restriction, payout hold, contract action, employment discipline where applicable, civil recovery, or referral to lawful authorities after review.
Delivery partners must comply with traffic laws, safety rules, lawful instructions, route safety notices, and vehicle requirements. Required personal protective equipment may include helmet, reflective vest, identification badge, uniform, rain gear, insulated bag, or other equipment listed in the signed schedule.
A delivery partner must not start work while impaired by alcohol, illegal drugs, unsafe fatigue, or medical condition that makes delivery unsafe. Accidents, injuries, vehicle defects, threats, theft, harassment, or unsafe conditions must be reported promptly through the available support or incident path.
If MarketLiberiAll provides a vehicle, device, cash bag, uniform, or equipment, it remains company property unless a signed schedule states otherwise. If a delivery partner uses a personal vehicle, the partner is responsible for licensing, roadworthiness, insurance where required, and lawful use unless the signed schedule says otherwise.
Delivery work may require app use, delivery status updates, location evidence, proof of pickup, proof of delivery, customer OTP, signature, photo, recipient details, or incident evidence. MarketLiberiAll uses this information for delivery operation, customer support, safety, cash reconciliation, dispute handling, fraud prevention, audit, and legal compliance.
Location and proof data must be truthful. Attempting to spoof location, fabricate proof, self-confirm customer proof, hide a failed delivery, or overwrite evidence is a serious breach.
Delivery partners must treat customers, partners, staff, and other delivery partners respectfully. Harassment, threats, violence, discrimination, intoxication, theft, privacy misuse, unsafe riding or driving, unauthorized passenger or cargo, and off-platform solicitation are prohibited.
Confidential information includes customer data, delivery routes, order details, pricing, payout details, app screens, operational procedures, partner information, security controls, and business plans. Confidentiality continues after the engagement ends.
Compensation, incentives, bonuses, reimbursements, deductions, and payout timing are stated in the signed schedule or current delivery earnings policy. Earnings may depend on completed eligible deliveries, county, service level, cash reconciliation, incident status, customer dispute, and safety compliance.
MarketLiberiAll may apply lawful holds, deductions, offsets, or recovery for verified cash shortage, unreturned property, damage caused by misconduct, duplicate payment, fraud, or other amounts owed, subject to employment law where the delivery partner is an employee.
MarketLiberiAll may suspend delivery access while reviewing safety, identity, document, vehicle, training, cash, fraud, customer, or incident concerns. The signed schedule states notice periods, termination rights, return-of-property duties, and final payment handling.
Employee delivery partners retain rights under the Decent Work Act of 2015, including applicable freedom of association, collective bargaining, non-retaliation, leave, overtime, and statutory protections. Independent contractor delivery partners retain rights provided by their signed agreement and applicable law.
